ISLAMABAD: The Islamabad High Court has issued an important order concerning shisha cafes, directing authorities not to take coercive action against businesses operating legally while seeking a response from the federal government in the case.
In its order, the court instructed the authorities to refrain from forced action against shisha cafes that are conducting their businesses in accordance with the law. However, strict legal action may be taken against establishments found operating illegally or violating applicable laws and permits.
The Islamabad High Court also directed the federal government to implement rules concerning shisha cafes within one month. The federal cabinet was instructed to expedite the approval of legislation and regulations aimed at restricting shisha smoking.
The court directed the Advocate General of Islamabad and the Additional Attorney General to raise the matter before the relevant authorities. The bench emphasized the need for a clear regulatory mechanism to address the operation of shisha cafes in the capital.
According to the court, protecting the younger generation from drugs and shisha smoking is the responsibility of the government. The absence of a proper legal framework for shisha cafes was described as a matter of concern, with authorities ordered to finalize the rules within one month and submit a compliance report.
The court further directed Islamabad Police to continue strict action against illegal shisha cafes, while the Anti-Narcotics Force was asked to cooperate with police in efforts to curb drug-related activities. At the same time, restaurants operating within the law were protected from unlawful action, although violations of laws or permits could result in strict legal proceedings.
The Islamabad High Court ordered that all related petitions be clubbed together and adjourned the hearing until October 13.
