The Lahore High Court has reinforced Marriage Agreement Rights by ruling that a husband is legally bound to fulfill commitments made in a separate agreement in addition to paying the dower amount mentioned in the marriage contract. The decision highlights the legal protection available to women regarding financial promises made at the time of marriage.
Justice Muhammad Sajid Mahmood Sethi issued an 11-page judgment while hearing a petition challenging a trial court’s decision. The court upheld the earlier ruling that directed the husband to transfer a five-marla house to his wife, as promised in a separate agreement signed on the day of the marriage.
The judgment stated that Marriage Agreement Rights extend beyond the terms recorded in the Nikahnama when additional legally valid commitments have been made. The court rejected the husband’s request to overturn the trial court’s verdict and declared the separate agreement enforceable.
According to the ruling, the husband had voluntarily promised to provide a five-marla house to his wife through an independent written agreement. The court observed that such commitments carry legal significance and cannot be ignored once accepted by both parties.
The judgment further emphasized that dower, or Haq Mehr, is a legal right of the wife rather than a favor granted by the husband. The court noted that under the law, dower is treated as a debt owed by the husband and remains enforceable regardless of the duration of the marriage.
Discussing Marriage Agreement Rights, the court observed that many women do not demand their dower during marriage due to social and family pressures. Therefore, a failure to seek immediate payment cannot be interpreted as a waiver of their legal entitlement.
The Lahore High Court also stated that dower may be agreed upon verbally, in writing, or even after marriage. The judgment concluded that courts dealing with family disputes should consider social realities alongside legal technicalities to ensure fair and equitable outcomes.
